Event Charters

For event charters, besides the APA, the Charterer will have to run with the expenses of hiring exterior staff, exterior catering, additional crockery/cutlery/crystal ware, protective carpeting, tents on quay, etc.

Terms & Condition

MYBA SPECIAL CONDITIONS
  1. The charterer shall attend and shall be responsible to ensure that all guests attend, safety briefings by the crew.
  2. The use of any personal watercraft (wave runners, jet skis, etc.) is at the operator’s sole risk and is only permitted subject to the operator having the applicable license, if required, and meeting local regulations. Any liability arising from noncompliance regarding the use of personal watercraft is entirely at the operator’s risk.
  3. Children (under 11 years) must be supervised at all times by a nanny.
  4. Broker and Stakeholder expect to receive funds in full. If total funds are not received, the shortfall will be deducted from the APA.
  5. The charterer shall be fully responsible to ensure that each guest is in possession of the proper visa/s for the desired cruising area.
  6. A crew gratuity is customary (between 10 % to 15%) but given entirely at the discretion of the charterer.
  7. Whilst every effort will be made to secure berthing in the chosen ports during the cruise, neither the owner, captain, broker nor stakeholder can be held responsible for the final allocation of any berth.
  8. Smoking is not permitted inside the yacht. Exterior of the yacht only.
  9. Funds are expected to be received in full. Any banking charges deducted from the installments will be charged to the APA account.
  10. The Parties agree and acknowledge that the First and the Second Installments are a guarantee deposit and the A.P.A. is a general deposit of funds to be used by the Charterer. Upon and subject to the performance of this Contract, as per clause 20 hereinafter, the First and Second Installments shall cover the payment of the total amount due for Charter Fees at the date of commencement of the Charter period.
  11. The operating costs in accordance to Clause 8 , will be on Charterer’s account and shall be deducted from the APA deposit; any operating costs eventually invoiced to the owning company in exemption of VAT will be charged to the Charterer and subject to the same standard VAT rate as applied to the charter fees and will be deducted from the APA deposit.
CONTRACT OF TRANSPORT CONTIONS
  1. Smoking & shoes are not permitted on board
  2. A crew gratuity is customary but given entirely at the discretion of the client.
  3. The use of any personal watercraft (wave runners, jet skis, etc.) is at the operator’s sole risk and is only permitted subject to the operator having the applicable license, if required, and meeting local regulations. Any liability arising from noncompliance regarding the use of personal watercraft is entirely at the operator’s risk. Diving rendez-vous only.
    Children (under 11 years) must be supervised at all times by a nanny or passengers.
  4. Whilst every effort will be made to secure berthing in the chosen ports during the cruise, neither the Service provider, captain, broker nor central agent can be held responsible for the final allocation of any berth
  5. The passengers has to be in possession of the proper visa/s for the scheduled cruising area
  6. The passengers must attend safety briefings by the crew
  7. Funds are expected to be received in full. Any banking charges deducted from the installments will be charged to the APA account
  8. Any outstanding accounts will be settled with the Captain, onboard and prior to disembarkation
  9. Any damage caused by any passenger to the yacht and her equipment shall be paid by the client or the passengers
  10. The service provider, his crew and the passengers shall use their best efforts to a) ensure that all crew members and all passengers are free of COVID-19 at the start of the charter and b) avoid the spread of infection during the cruising. The service provider, his crew and the passengers understand and accept that, even with the most stringent measures in place, a level of risk may remain. If, despite their best efforts, any passengers or any crew member develops symptoms of COVID-19 during or within 14 days of the end of the cruise, each party agrees to hold the other harmless.
  11. In case of contamination by Covid-19 onboard the yacht by the crew, the charter would be postponed at pro rata of the remaining days.
  12. In case of contamination by the Charterer or guest, the contaminated person would be disembarked and isolated as per protocole but the charter will be not postponed or reimbursed.
IF COVID-19 IS STILL ACTIVE
  1. Both parties shall use their best efforts to a) ensure that all crew members and all members of the Charterer’s party are free of COVID-19 at the start of the charter and b) avoid the spread of infection during the charter. Both parties understand and accept that, even with the most stringent measures in place, a level of risk may remain. If, despite their best efforts, any member of the Charterer’s party or any crew member develops symptoms of COVID-19 during or within 14 days of the end of the charter, each party agrees to hold the other harmless.

In case of contamination by Covid-19 onboard the yacht by the crew, the charter would be postponed at pro rata of the remaining days.

In case of contamination by the Charterer or guest, the contaminated person would be disembarked and isolated as per protocole but the charter will be not postponed or reimbursed.

IMPORTANT NOTES

FULL IDENTIFICATION OF THE CHARTERER ON THE CONTRACTS:

The contract must necessarily include the Charterer’s full details including full registered address and passport or personal ID number. If the Charterer were an EU based corporate entity the contract must specify its full registered address and VAT number

(If it were a non-EU corporation instead of the VAT number please write the company’s tax identification number -TIN #- or its incorporation number in the chamber of commerce of the country where it is registered).

 

Even if the Broker has run all perceptive checks on the Charterer, to meet EU anti-money laundering laws (AML) and solely

for Due Diligence purposes, prior to signing the contract the Owning company may ask for a copy of the passport of the Principal

on board during the charter.

 

Should the contract be issued in name of a company, the Charterer must provide a signed “Responsible Person on Board Declaration” identifying who shall be regarded as  Principal Guest by providing his full data (name, address, nationality and passport nr), clarify what is the relationship between the Charterer and the Principal Guest (For example: the Principal Guest is the Company’s CEO, CFO, director, shareholder, business partner, etc.) and expressly confirm that the Company assumes all obligations on behalf of the Principal Guest, included but not limited to assuming full responsibility over the payment of all funds immediately as they become due. This declaration must also fully identify the signatory, including his title in the company. For obvious reasons the signatory of this declaration must be the same person signing the Charter Agreement on behalf of the Company.

 

NB: we can assure you that no one from the Owner’s party including the Captain, the crew and ourselves will never use this information to contact your client directly. Our reputation is paramount.
